0. Introduction – How to Read These Terms

Welcome to Cloud Adventures. These General Terms & Conditions (“Terms”) explain how bookings, vouchers, and services on www.cloudadventures.sk work.

• What we do: Cloud Adventures runs an online platform that connects passengers with licensed pilots and operators offering sightseeing, leisure, and cost-sharing flights. We are not an airline and do not operate flights ourselves.

• Who is responsible: Cloud Adventures manages bookings and payments. Operators (pilots, flight schools, aircraft owners) are responsible for performing the flights in line with aviation law and safety rules.

• Why these Terms matter: They protect both you and us. They explain your rights (e.g. refunds, cancellations, data protection) and your obligations (e.g. providing accurate information, following safety instructions).

• Consumer rights: Nothing in these Terms affects your rights under EU and national consumer law.

By making a booking, you agree to these Terms.

2. Definitions

• Platform: the website www.cloudadventures.sk.

• Customer/You: a consumer booking a flight or voucher.

• Operator: independent licensed pilot, aircraft owner, or flight school providing the flight.

• Service/Flight: sightseeing, leisure, or cost-sharing flight offered through the Platform.

• Voucher: a gift card redeemable for flights booked via the Platform.

• Direct Costs: costs directly related to the performance of a flight, such as fuel, oil, landing and airfield fees, aircraft rental, maintenance, and insurance, in accordance with EASA Part-NCO.

3. Nature of Services

• Cloud Adventures is an intermediary: we connect Customers and Operators.

• Flights are performed under EASA Part-NCO rules (non-commercial operations with other-than complex aircraft).

• Cloud Adventures does not hold an Air Operator Certificate (AOC). We do not provide commercial airline services.

• Operators must:

• hold valid pilot licences and medical certificates,

• ensure their aircraft is airworthy, maintained, and insured under Regulation (EC) No 785/2004,

• comply with all applicable EU and national aviation laws.

• Aero Taxi requests: where commercial air transport is required, requests may be forwarded to duly licensed AOC holders.

4. Booking & Payment

• Bookings are confirmed when you receive written confirmation (email).

• All prices are shown in EUR, incl. VAT (where applicable).

• Payments are processed securely via ComGate Payments, a.s. (Czech Republic).

• Cloud Adventures holds funds until the flight has been completed.

• The final sale price shown on the Platform is determined solely by Cloud Adventures and includes platform service fees and applicable taxes. The Operator is reimbursed for their agreed share of Direct Costs. Promotions, vouchers, or discounts offered by Cloud Adventures are borne entirely by Cloud Adventures and do not reduce the Operator’s reimbursement.

5. Right of Withdrawal

• Vouchers (not tied to a date): You may withdraw within 14 days of purchase, with full refund.

• Flights tied to a specific date/time: Withdrawal right does not apply (Art. 16(l) Directive 2011/83/EU). Cancellation terms (Section 6) apply.

6. Cancellation & Refunds

Cancellations and refunds work as follows:

• Refunds are issued within 14 days from the effective date of cancellation or withdrawal, to the original payment method unless otherwise agreed.

• Operator cancellations always give you the choice between a refund or rebooking.

7. Gift Vouchers

• Valid for 3 years from purchase date.

• Redeemable online or by phone using the voucher code.

• Not exchangeable for cash.

• If the booked service exceeds the voucher value, you pay the difference.

• Withdrawal rights under Section 5 apply.

8. Aviation-Specific Disclaimers

• Weather & operational conditions: Flights depend on weather, aircraft availability, and air traffic restrictions. Flights may be delayed, rerouted, or cancelled at short notice for safety reasons.

• Pilot in command: The pilot has full authority under aviation law. Their decision on route, altitude, and whether the flight may proceed is final.

• No guarantee of route/sightseeing: Exact flight path may vary due to weather, airspace rules, or pilot judgment.

• Not an airline: Flights are leisure experiences, not point-to-point transport. They are not covered by EU airline passenger rights (Regulation 261/2004).

• Acceptance of risks: Customers acknowledge that general aviation flights, while safe, involve more operational uncertainties than commercial airline flights.

9. Liability & Insurance

• Cloud Adventures is liable only for the proper functioning of the Platform and payment handling.

• Operators are solely responsible for safe flight execution, compliance with regulations, and insurance.

• Nothing in these Terms limits liability for death, personal injury, or gross negligence.

• All flights are insured as required by Regulation (EC) No 785/2004 (liability insurance for air carriers and aircraft operators).

10. Customer Duties

• You must provide accurate booking details.

• You must follow all pilot instructions for safety.

• Boarding may be refused if you are under the influence of alcohol/drugs, or if you pose a safety risk.

11. Complaints & Dispute Resolution

• We acknowledge complaints within 5 working days and aim to resolve them within 30 days.

• Consumers may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

• Supervisory authority: Slovak Trade Inspection.

12. Governing Law & Jurisdiction

These Terms are governed by Slovak law. Mandatory consumer rights of your habitual residence remain unaffected.

13. Final Provisions

• If one clause is invalid, the rest remains valid.

• Amendments must be in writing.

• The current version of these Terms is always available on www.cloudadventures.sk.
