0. Introduction


Welcome to Cloud Adventures. These Terms & Conditions (“Terms”) govern:
• the use of the website www.cloudadventures.us (“Platform”),
• the purchase of vouchers,
• the booking of aviation-themed experiences,
• and the organization of non-aviation services packaged with such experiences.


Cloud Adventures provides aviation-related events and experiences, while all flights are performed exclusively by independent Operators under EASA Part-NCO cost-sharing rules.


By using the Platform or booking any service, you accept these Terms.

2. Definitions


“Platform”


The website www.cloudadventures.us


“Customer / You”


A consumer purchasing a voucher, experience, or event.


“Operator”

Independent aviation providers performing the actual flight, including:
• licensed pilots
• aeroclubs
• flight instructors
• flight schools
• aircraft owners
• aviation associations

“Flight / Flight Experience”

A cost-sharing flight under EASA Part-NCO, including:
• sightseeing flights
• experience/discovery flights
• cost-sharing flights
• Pilot for a Day / Pilotom na skúšku instructional experiences
These are private, non-commercial flights, not air taxi or commercial air transport.


“Experience / Event”


An aviation-themed package organized by Cloud Adventures, which may include:
• Flight Experiences (operated by Operators)
• Catering
• Photography/videography
• Merchandise
• Hangar or venue rental
• Transport
• Teambuilding activities
• Workshops and hospitality services


Non-flight services may be delivered by subcontractors.


“Voucher”
Prepaid credit redeemable for services on the Platform.


“Direct Costs”
Fuel, oil, landing fees, maintenance, rental, and insurance — as permitted under Part-NCO cost-
sharing rules.

3. Nature of the Services
3.1 Cloud Adventures as Experience Organizer
Cloud Adventures:
• organizes aviation-related events and experiences,
• coordinates all non-flight services,
• acts as the Customer’s contractual partner for the overall experience,
• provides customer support and event coordination.
3.2 Independent Flight Operation
All Flights:
• are cost-sharing flights under Part-NCO,
• are operated exclusively by independent Operators,

• fall under the full authority of the Pilot-in-Command (PIC).
Cloud Adventures does not:
• operate aircraft,
• hire or command pilots,
• provide flight instruction,
• issue operational decisions,
• hold or require an Air Operator Certificate (AOC).


3.3 No Charter or Air Transport
Cloud Adventures does not provide charter flights or commercial air transport.

4. Booking & Contract
• A booking is confirmed once a confirmation email is issued.
• Cloud Adventures is your contractual partner for the overall experience/event.
• The Operator is your service provider for the flight portion.
• Subcontractors may provide photography, catering, transport, or other services coordinated by
Cloud Adventures.

5. Prices & Platform Fees


5.1 Composition of the Customer Price


The final customer price includes:
• Direct Costs reimbursed to the Operator,
• Cloud Adventures platform and coordination fees,
• subcontractor fees,
• administrative and service charges,
• applicable taxes.


5.2 Operator Reimbursement


Operators receive only their proportional share of Direct Costs in accordance with EASA Part-NCO.
They do not receive platform fees, margins, or profit.


5.3 Independent Price Setting


Cloud Adventures independently determines the final customer-facing price.

Operators cannot influence pricing.

6. Withdrawal, Refund & Voucher Validity


6.1 Statutory Withdrawal (EU Law)


For vouchers and purchases without an agreed date:
• 14-day withdrawal period applies,
• full refund if unused.


6.2 Voucher Validity
• Vouchers are valid for 1 year.
• After expiry, they may still be redeemed, subject to an inflation/Direct Cost adjustment fee.


6.3 End of Withdrawal Right After Scheduling


Once a Customer:
1. contacts an Operator, and
2. agrees on a specific flight date and time,
a leisure service contract for a fixed date is formed (Art. 16(l) Directive 2011/83/EU), and the statutory withdrawal right ends.
Cancellations follow Section 6.4.


6.4 Cancellation of Date-Specific Bookings

Customers must notify both Cloud Adventures and the Operator as early as possible.

6.5 Operator Cancellations


If a flight is cancelled due to weather, safety, technical issues, or airspace restrictions:
• 100% refund, or
• free rescheduling.


6.6 Refund Timing


Refunds are processed within 14 days.

7. Aviation-Specific Disclaimers


• Flights depend on weather and operational conditions.
• Exact routes and duration may vary.
• The PIC has full legal authority over the flight.
• EU Regulation 261/2004 does not apply.
• General aviation may involve delays or rerouting.


Cloud Adventures is not responsible for:
• flight performance,
• safety or operational decisions,
• airworthiness,
• Operator regulatory compliance.

8. Liability
8.1 Cloud Adventures


Responsible for:
• event organization,
• platform operation,
• communication,
• payment processing.


Not liable for:
• aviation-related risks,
• technical issues,
• pilot decisions,
• delays or cancellations due to weather/airspace,
• subcontractor performance outside its control.

8.2 Operators


Responsible for:
• flight safety,
• regulatory compliance,
• airworthiness and maintenance,
• insurance under EC 785/2004.


8.3 No Additional Insurance


Cloud Adventures does not provide aviation or event insurance.
Participation is under the Operator’s insurance coverage.

9. Customer Responsibilities


Customers must:
• provide accurate information,
• follow Operator instructions,
• behave safely around aircraft,
• not board under the influence of alcohol or drugs,
• respect weight/baggage limits,
• arrive on time.


Operators may refuse boarding for safety reasons, including intoxication.
In such cases, the Customer has no right to a refund according to the Refund Policy.

10. Complaints & Dispute Resolution

Supervisory authority: Slovak Trade Inspection.

11. Governing Law


Slovak law applies.
Mandatory consumer protections in your home country remain unaffected.

12. Final Provisions


• Invalidity of any clause does not affect the rest.
• Modifications must be in writing.
